Minimum Requirements

Applicants for Assistant State Attorney must meet the following to be considered:

• Qualifications:
  • LLB degree or recognised 4-year legal qualification
  • Admission as an Attorney of the High Court of South Africa
• Experience:
  • Minimum 2 years post-qualification legal/litigation experience
• Other Requirements:
  • Valid driver’s licence
  • Computer literacy (MS Word, Excel, Outlook)
  • Strong legal research and drafting ability
  • Dispute resolution skills and case flow management experience
  • Excellent written and verbal communication skills
  • Strategic and conceptual thinking ability

Key Duties & Responsibilities

As an Assistant State Attorney, you will:

1. Litigation & Case Management

• Represent the State in the High Court, Magistrates’ Court, Labour Court, Land Claims Court, and CCMA
• Manage litigation files from initiation to finalisation, ensuring compliance with procedural timelines
• Draft court documents including pleadings, affidavits, and heads of argument

2. Legal Advisory Services

• Provide strategic legal opinions to various State departments
• Assess legal risks and advise on measures to ensure compliance with legislation

3. Contract Drafting & Review

• Draft and review contracts, service-level agreements, and settlements on behalf of the State
• Ensure legal instruments meet constitutional and statutory requirements

4. Dispute Resolution & Arbitration

• Conduct negotiations to resolve disputes before trial
• Represent the State in interdepartmental arbitration and debt collection proceedings

5. Research & Legal Development

• Conduct in-depth legal research on complex matters
• Stay updated on legislative amendments, case law developments, and policy shifts
