Minimum Requirements
Applicants for Assistant State Attorney must meet the following to be considered:
- Qualifications:
- LLB degree or recognised 4-year legal qualification
- Admission as an Attorney of the High Court of South Africa
- Experience:
- Minimum 2 years post-qualification legal/litigation experience
- Other Requirements:
- Valid driver’s licence
- Computer literacy (MS Word, Excel, Outlook)
- Strong legal research and drafting ability
- Dispute resolution skills and case flow management experience
- Excellent written and verbal communication skills
- Strategic and conceptual thinking ability
Key Duties & Responsibilities
As an Assistant State Attorney, you will:
1. Litigation & Case Management
- Represent the State in the High Court, Magistrates’ Court, Labour Court, Land Claims Court, and CCMA
- Manage litigation files from initiation to finalisation, ensuring compliance with procedural timelines
- Draft court documents including pleadings, affidavits, and heads of argument
2. Legal Advisory Services
- Provide strategic legal opinions to various State departments
- Assess legal risks and advise on measures to ensure compliance with legislation
3. Contract Drafting & Review
- Draft and review contracts, service-level agreements, and settlements on behalf of the State
- Ensure legal instruments meet constitutional and statutory requirements
4. Dispute Resolution & Arbitration
- Conduct negotiations to resolve disputes before trial
- Represent the State in interdepartmental arbitration and debt collection proceedings
5. Research & Legal Development
- Conduct in-depth legal research on complex matters
- Stay updated on legislative amendments, case law developments, and policy shifts
